Optincall, Inc. ("Optincall", "we", or "us") was founded to help put consumers back in control of the collection and use of their personal information when shopping for goods and services. This Privacy Policy ("Policy") describes what information we collect, how we use that information, and your privacy rights regarding that information.

Collection of Information and Your Privacy Rights

What information we collect and how we collect it.

1.1. User Information. Optincall collects information from you when you voluntarily provide it to Optincall or one of its partners, through websites (owned and operated by us or a third party); social networking, mobile, gaming and other applications providers; through telephone calls with merchants participating in our programs and other means (together, these sources are referenced hereafter as "Publishers"), or by others means of online or offline surveys, order forms, or registration pages operated by third parties (collectively, a "User Form"). In a User Form, Optincall or a third party may offer you incentives in exchange for providing information about yourself such as name, email address, street address, zip code, telephone numbers, birth date, gender, salary range, education and marital status, occupation, employment information, and personal and online interests (together, "User Information"). Completing the User Form is voluntary and you are under no obligation to provide User Information.

1.2 Vendor List Information. Optincall may obtain information about you after you provide information to a third party and you permit that party (the "Seller") to share the information, which Optincall subsequently purchases, licenses, or otherwise lawfully acquires. Such information may include, but is not limited to, your name, street address, zip code, telephone numbers, birth date, gender, salary range, education, marital status, occupation, industry of employment, personal and online interests, and other information which you provided to the Seller (together, "Vendor List Information"). When acquiring Vendor List Information, Optincall requires assurances from the Seller that the Seller has a right to transfer the Vendor List Information to Optincall and that the Optincall may lawfully use the Vendor List Information to facilitate the transmission of offers from advertisers.

1.3 User Behaviors Collected with Cookies, Web Beacons, and Other Information. Optincall uses cookie and web beacon technology to associate certain Internet-related information about you, such as your Internet Protocol address and what Web browser you are using, to facilitate your use of our platform and apps and provide you with a more appealing user experience. Optincall reserves the right to use other new and evolving sources of information and information gathering in the future (together, "Technology Information").

(a) Cookies. A cookie is a small amount of data stored on the hard drive of your computer or an app on your mobile device that allows Optincall and/or its partners to identify your IP address with corresponding information in Optincall's database. These cookies may reflect demographic or other data linked to data you voluntarily submitted to us, such as your email address, that we may share with a third party, in hashed or encrypted form. (b) Web beacons. A web beacon is a type of programming code which displays an image on a web page, and can further transfer an individual's user identification to a database in order to associate the individual with previously acquired information about the individual. Web beacons help determine products or services in which you may be interested and help track your online behaviors in order to better customize marketing to your interests. (c) Where Technology Information is Collected. Technology Information is collected directly from your use of Optincall’s platforms or indirectly through advertisers with whom Optincall contracts to participate in Optincall’s services. Technology Information will usually be collected through one of the following vehicles:

Websites.Optincall may set a cookie on your computer or mobile device when you interact with your customer account platform. This cookie may inform Optincall, for example, that you are viewing your account using a mobile iOS device, or a mobile Android device, or a large computer screen, to enable convenient formatting for you. You may also select preferences about whether you wish to re-enter your password credentials each time you access your account, and those preferences may be set on a cookie for future retrieval.

Software Programs. If you use apps on your mobile device to interact with Opticall, we may collect information about the nature of your device, including the operating system it uses, to determine how to display your account information to you on the device.

Telephone calls and Databases. Optincall and/or its partners may track and record your telephone interactions, to assist you in the provision of goods and services, as well as to score your behavior and honor your preferences. For example, if you elect to make a purchase in the course of a call, and provide information about yourself, including payment information, to facilitate the purchase, it will be recorded and tracked to enable the sales transaction. If you complete a call with a merchant but do not make a purchase, you will nevertheless be rewarded for your participation in the program, as further detailed in your program terms and conditions. Optincall will record information about each call to facilitate tracking of rewards and requests made by you, including the request to unregister a particular telephone number or delete your Optincall account. You may be sent system emails following each call to enable you to track your own participation and rewards earned in the Optincall program. You may opt out of receiving system emails providing you stats on your calls, and you may also opt out of having your calls recorded, at any time through your Optincall customer account.

1.4 Outside Information. Optincall may lawfully receive information about you from third parties, such as information located in public databases ("Outside Information").

1.5 No Information Collected from Minors.MINORS UNDER THE AGE OF 18 SHOULD NOT PROVIDE ANY PERSONAL INFORMATION, INCLUDING THEIR EMAIL ADDRESS OR TELEPHONE NUMBER, TO OPTINCALL. If Optincall is notified it has personal information about a minor under the age of 18, that information will be promptly deleted from our databases.

1.6 Individual Information. As used herein, Individual Information means User Information, Vendor List Information, Technology Information, Outside Information, and any other information Optincall lawfully obtains about you.

Use of Information and User Data

How we use and share the information we collect.

2.1 Discretion to Use Information. Information voluntarily provided to Optincall or lawfully obtained by Optincall is the property of Optincall and may be used by Optincall for any lawful purpose. If you wish to end your participation in any Optincall program, you may follow the instructions at the end of each email message to unsubscribe or follow the instructions detailed at Section 4 below.

2.2 Targeted Advertising and Information.Optincall uses Individual Information to target advertising and other information, such as business, weather, entertainment, sports and general news alerts and similar information, more effectively. When you register your interest in a category of goods or services (for example, auto insurance or vacation travel), we will use your indication of interest to direct merchants offering such goods and services to call you at the phone number and during the times you instructed. Optincall uses Technology Information to associate you with your Individual Information and assist participating merchants to speaking with you utilizing information, if any, which you asked to be shared with the participating merchants. For example, if you selected preferences noting interest in auto insurance, and asking that each participating auto-insurer calling you under Optincall’s program be notified that you want to insure a 2010 Ford Focus with 10,000 miles, Optincall will attempt to fulfill your request, in order to shorten the length of your call and increase the speed at which you may be offered a firm auto insurance quote.

2.3 Legal Process. Optincall may disclose Individual Information to respond to subpoenas, court orders and other legal process as required by law.

2.4 Summary Data. Optincall reserves the right to sell or transfer non-individualized information, such as summary or aggregated anonymous information about all persons or sub-groups of persons, participating in Optincall’s programs.

2.5 Business Transition. Optincall may transfer all or part of your Individual Information as part of a business transition such as a merger, acquisition, recapitalization or asset sale.

How we store and protect the information we receive.

2.6 Storage of Individual Information. Optincall stores Individual Information in a database on Optincall computers; the information is maintained and stored in encrypted form. In addition, Optincall’s computers have security measures, such as a firewall, to protect against the loss, misuse, and alteration of the information under Optincall's control. Optincall also maintains physical and procedural safeguards to protect Individual Information. Notwithstanding such measures, Optincall cannot guarantee that its security measures will prevent these computers from being illegally accessed and the Individual Information on them stolen or altered.

Privacy Practices of Third Parties.

Third Party privacy policies and use of cookies.

3.1 Advertiser cookies and web beacons. Publishers who place advertisements on the Internet may use their own cookies, web beacons and other technology to collect information about you. Optincall does not control Publishers' use of such technology. Optincall may place cookies of its Publishers or advertisers who are under contract with Optincall, on your computer or mobile device. These cookies may be placed at the time you open and/or click within email sent by Optincall or a Publisher under contract with Optincall. This Policy does not apply to the practices of Publishers or other companies that Optincall does not own or control or to people that Optincall does not employ or manage.

3.2 Links. The Publishers' Website and email messages transmitted by Optincall on its own behalf or on behalf of Publishers may contain hypertext links to the Websites of third parties. Optincall is not responsible for the privacy practices or the content of such other Websites.

3.3 Affiliated Companies that are not Publishers. Optincall may disclose or transfer Individual Information to wholly owned or controlled Optincall entities in Optincall's discretion.

3.4 Third Party telephone calls. Calls placed to a telephone number you registered with Optincall, by a merchant participating in Optincall’s programs, will reflect a unique Optincall Caller ID as further detailed in your program terms and conditions. Optincall does not own or control, and is not responsible for the actions of, third party merchants who do not call through the Optincall program as indicated if the call you receive does not show an Optincall Caller ID, or if the merchant is using a technology to spoof or imitate Optincall’s unique Caller ID.

How You May Exercise Your Privacy Rights.

4.1 Phone Calls. ou may always ask a participating merchant to suspend use of your registered telephone number from further Optincall program participation, at the time the merchant calls you. Merchants participating in Opticall’s program will only contact you through the telephone number(s) you registered through your Optincall account.

4.2 Websites. To prevent the display of Publisher or Optincall advertising on a Website, for example, banner advertisements, do not visit the Website. To only prevent Optincall from tracking your behavior on a Website, turn off cookies from that Website and do not click on or interact with any advertisements. Optincall does not have a mechanism or process to respond to any "do not track" signals which a web browser may send or receive, other than as described in this section.

4.3 Email Databases. To unsubscribe from Optincall or Publisher email lists, click the link included in the footer of any message delivered by Optincall or a Publisher participating in an Optincall program and follow the instructions provided. You may also unsubscribe from the Optincall network by visiting https://www.optincall.com/subscriptions/.

4.4 Software Programs. To prevent software programs from displaying advertisements on your computer, uninstall the software program provided by an Optincall or an Optincall Publisher by following the instructions included in the privacy policy at the time of installation. Software programs should include an option to uninstall in the "Add/Remove Programs" section of the Windows® operating system, or placing the app in the trashcan of the OSX operating system.

4.5 Cookies. Check instructions about your web browser to learn how to prevent placement of, or how to remove, cookies placed on your computer or mobile device by Optincall.
